Ohio Revised Code section 4701.01(A) defines the practice of law as "advising or representing others in legal matters." Preparing immigration applications, which requires knowledge of immigration law and providing legal advice, constitutes the practice of law.
Activities (A), (B), and (D) do not involve the preparation of legal documents or providing legal advice, and therefore do not constitute the unauthorized practice of law in Ohio. Referring a principal to a qualified immigration lawyer (A) or advising a principal to call a lawyer referral service operated by a Bar Association to find immigration counsel (B) are not considered the practice of law, and administering an oath and witnessing the signature on an affidavit (D) is a notarial act that does not involve the practice of law.
